On May 1, the U.S. Court of Appeals granted the Air-Conditioning, Heating, and Refrigeration Institute (AHRI) motion for stay of the compliance date for non-weatherized natural gas furnaces. Under the regional standards rules, new minimum energy conservation standards of 80% AFUE would go in effect as of May 1, 2013. The stay delays the effective date until November 1, 2013 and eliminates the possibility of these rules being enforced by states, building inspectors, etc. despite the notice of ‘non-enforcement’ issued by the DOE.
